Right on Public Areas

요한난 2021. 3. 12. 19:20

The general public has certain rights, particularly in public areas and facilities. Every impediment, impairment, or inhibition of use or rights is a violation of civil law. Every road should be open to everyone, and there should be a right of way where it is not designated to be privatized. According to the Philippine Civil Code, everyone has the right to exercise their rights, and violations of these rights are punishable. A nuisance is defined as any act, omission, or establishment that endangers, offends, is immoral, obstructs, or hinders the use of a property. The penal code allows for the prosecution of any public nuisance. The public areas, particularly the road, belong to no one but the public and should be open to all.
